The constitutionally guaranteed rights to life and physical integrity oblige the state to take effective measures to prevent traffic accidents and ensuing damages. There has been a great success in road safety in the last 40 years: reduction of people who were killed from more than 20.000 a year to 3.648 in 2010. But these are still too much and measures of road safety are further necessary.
In legal practice violations of traffic rules usually pass for trivial offence. They are obviously less scored by judges than offences like larcenies. Speed accidents have namely extraordinary consequences for the individual person and the whole social community but the sanctions are comparatively low.
